Dear readers,
This issue focuses on the work of the CIV Committee, specifically the application of the revised PRR and the next steps on the Agreement for Journey Continuation (AJC). The latter is particularly relevant in light of the European Commission’s current political agenda. We also report on a successful Passenger Claims conference, which to participants’ great satisfaction took place as a 100% in-person event. The issue also reports on the latest developments in wagon law and on the TTR project.

Keeper liability with the obligation of the Entity in Charge of Maintenance
With the concept of the Entity in Charge of Maintenance, a new player has entered the environment of those involved in the life of a wagon, one which contributes greatly to transport safety. To what extent do the keeper and his ECM interact?
A legal first: Court of Justice of the European Union rules on liability questions under the CUI Uniform Rules
In a preliminary ruling of the Court of Justice of the European Union of 14 July 2022 (C 500/20), a court has for the first time ever looked at the interpretation of the CUI and made a decision. The Court decided on its competence to interpret the CUI and after an affirmation, gave its statement on liability rules.

CIV Committee takes major decisions
After two years of online-only meetings, this year’s CIV Committee meeting was held as a hybrid event. Approximately half the participants were present in Bern, while the others attended remotely. The CIV Committee’s September meeting took some far-reaching decisions, signing off on the CIT “passenger” products which had been rendered fit for purpose in view of the new PRR now in force and on the AJC accompanying leaflet.

The new Passenger Rights Regulation and the Agreement on Journey Continuation were the highlights of this year’s CIT/UIC Passenger Claims Departments’ Conference, which was held on 28 September 2022 in Bern.
